Before drafting a power of attorney for a Spanish-speaking country, the receiving institution's requirements determine everything: whether a specific form is mandated, what content must appear, whether an apostille is needed, and whether the receiving party is a government office, court, bank, or private company. There are three ways to prepare one — we've handled real cases through all three.

Method 1: Consular certification

The destination country's diplomatic mission in Korea drafts and certifies the POA directly, in the consul's name. Best when you can review a draft with the consulate and attend an interview with the consul.

Method 2: Notary signature certification (서명공증)

Used when a notary's certification or an apostille is required. The POA is drafted in Spanish, brought together with a Korean translation, and you sign or seal it in person before a notary — this is a 서명공증 (signature certification), not a "번역문 인증" (translation certification). Requesting translation certification for a signed instrument like a POA is a common mistake that gets rejected at the notary office or, worse, accepted here and rejected at destination.

Method 3: Administrative agent fact-verification certificate (사실확인증명서)

When no apostille, notary certification, or consular form is required, we draft the POA in Spanish based on the content you provide, you review and sign it in our presence, and we attach a 사실확인증명서 (Certificado de verificación de hechos) confirming the signing took place. Simplest and fastest of the three.

Who needs this

Anyone granting authority to someone else for a transaction in Spain or Latin America — selling or managing property, handling a bank account, appearing in court, or completing government paperwork on your behalf while you remain in Korea. Real estate transactions and inheritance matters are especially common reasons for a POA request.

Typical timeline

Method 3 (fact-verification) is usually the fastest, often completed within a few business days once content and signing are arranged. Methods 1 and 2 depend on consulate appointment availability or notary office scheduling, which can add time beyond our own turnaround.

Common mistakes

• Assuming any of the three methods is interchangeable — the receiving institution's specific requirement determines which one is valid
• Requesting translation certification instead of signature certification for a document you're signing
• Not confirming apostille requirements before choosing a method, since some methods pair more naturally with an apostille than others

The fact-verification method (Method 3) starts at ₩88,000 (VAT included). Consular certification and notary signature certification are quoted individually, since fees and requirements are set by the consulate or notary office.
