Service members and military civilian employees (군무원) who receive a disciplinary punishment or an adverse personnel decision — a promotion omission, a shortened leave allowance, assignment to a 군기교육대 (disciplinary education unit), or a formal reprimand — have the right to challenge it through an appeal (항고) or personnel grievance (인사소청) to a higher command or the Central Personnel Grievance Committee. Many service members hesitate to file, worried that appealing will provoke retaliation or a harsher re-sentence — but under current law, an appeal or grievance can never result in a punishment heavier than the original.

What military disciplinary appeal covers

  • Appeal (항고) against a disciplinary committee's punishment decision — punishment types range from 강등 (rank reduction), 군기교육 (disciplinary education, which extends the service member's discharge date by the sentence length), 감봉 (pay reduction), to 휴가단축 (leave-day reduction)
  • Personnel grievance (인사소청) against an adverse personnel action — promotion omission, leave-day reduction, and similar administrative disadvantages
  • 군기교육대 (disciplinary education unit) sentence review, including a legality-review opinion statement (적법성심사 의견서) filed before the sentence is finalized — a higher-echelon (e.g. corps-level) legality check that sits between the committee's decision and the sentence actually taking effect
  • Stay of execution (집행정지) — a separate filing that freezes a 군기교육대 sentence (and the discharge-date delay it causes) while an appeal is pending, so the service member isn't already serving the sentence by the time the appeal is decided
  • Double-punishment (이중징계) challenges — two recurring patterns: re-punishing a matter already closed with an earlier warning/action, or splitting one incident into multiple separately-punished violations
  • Disciplinary record access (징계기록 열람·복사) before drafting the appeal — the disciplinary decision notice itself rarely states the actual evidence or reasoning the committee relied on
  • Post-discharge appeal — an appeal against a disciplinary decision can still be filed within 30 days even after the service member has already been discharged, and a discharge record can be retroactively corrected (e.g. a "discharged as 상병" record upgraded to 병장) if the appeal succeeds
  • Written opinion before the disciplinary committee meets (징계 의견서): filed between the attendance notice and the committee date, or at the written-deliberation stage, to correct the facts, present mitigating circumstances and argue for a lighter sanction before any decision is made
  • Appeal against a disciplinary surcharge (징계부가금) decision, which goes through the same appeal procedure as a disciplinary punishment

Forced-retirement review (전역심사) is a separate proceeding from disciplinary punishment

A referral to 전역심사 under Military Personnel Management Act Article 37 isn't a punishment for misconduct — it's a fitness-for-continued-service review that can end in involuntary discharge on its own track, triggered either by a medical/psychological fitness rating or by a "현역복무부적합" (unfit for active duty) finding:

  • Medical/psychological fitness ratings aren't the final word: Korean administrative courts have held that the fitness-grade criteria in the implementing regulation are an internal administrative guideline (사무처리준칙), not a binding legal rule — in one case, a service member medically rated at a grade that would normally trigger retirement had her retirement order overturned because she had continued performing her duties normally after treatment, and the court required a holistic review of actual fitness for duty, not just the numeric grade
  • The 3-category unfitness test: a 현역복무부적합 finding requires showing the service member falls under (1) insufficient ability to perform the duties of their rank, (2) a character defect making continued service untenable, or (3) a lack of good faith in performing duties — each with specific enumerated sub-grounds in the implementing regulation, and a prior disciplinary or criminal record triggers a mandatory review under Article 57
  • A parent's own statement, given legal structure: a parent's personal appeal letter carries genuine persuasive weight, but turning it into grounds for a reduced sanction or reinstated status requires framing it against the proportionality of the punishment and whether the investigating process was procedurally sound — not just describing good character

What we handle

  • Reviewing the disciplinary committee's decision or the personnel order and identifying the strongest grounds for appeal
  • Drafting and filing the appeal (항고서) or personnel grievance petition within the 30-day statutory deadline, calculated correctly under the day-one-excluded (초일불산입) rule
  • Requesting and reviewing the disciplinary record under Ministry of National Defense directive Article 29 (「국방부 군인·군무원 징계업무처리 훈령」 제29조) — what evidence the committee actually used, how the service member's own statement was recorded, and whether the sentencing and procedure were properly applied
  • Preparing a legality-review opinion statement before a disciplinary-education sentence is finalized, which can reduce the length of the sentence
  • Filing for a stay of execution alongside an appeal, when the sentence would otherwise take effect before the appeal is decided
  • Contesting a 전역심사 referral or forced-retirement order — building the case that fitness for duty must be assessed holistically, not by a fitness-grade number alone
  • Coordinating with the service member (and their family) throughout the appeal or grievance hearing process, including structuring a parent's own statement into a legally persuasive filing alongside the service member's own statement
  • Drafting the pre-committee written opinion (징계 의견서) and supporting materials when a service member has been called before a disciplinary committee, so the defense starts before a sanction is decided

How the process works

  1. We review the disciplinary decision or personnel order and confirm the appeal or grievance deadline that applies.
  2. We request the disciplinary record and draft the appeal or grievance petition, gathering supporting evidence and precedent.
  3. We file within the statutory window — with a stay-of-execution filing alongside it where the sentence is otherwise about to take effect — and represent the service member's position through the hearing.

How the 30-day appeal deadline is counted

  • The clock starts on the day the service member actually received and signed for the disciplinary notice (징계처분서), not the issue date printed on it. That day is not counted, so the next day is day 1.
  • Saturdays, Sundays and public holidays in between all count. If day 30 falls on a Saturday or a public holiday, the deadline moves to 18:00 on the next working day. For an appeal sent by post, the postmark date of the sending post office counts.
  • Filing in two steps: a short appeal form (항고서) with a copy of the disciplinary notice is filed within a week of receipt to secure the deadline. The detailed statement of grounds (항고이유서) follows before the appeal review committee (항고심사위원회) meets, once the disciplinary record has been analyzed.
  • There is only one appeal. Once the committee has decided, or the appeal is withdrawn, the same case cannot be appealed again, so every argument and document has to go into the first statement of grounds.

Why a light punishment still matters: promotion and rank at discharge

  • For enlisted members, each punishment adds a promotion restriction once the minimum service period for the next rank has passed (군인사법 시행규칙 제36조 제2항 제2호): 3 months for 강등 or 군기교육, 2 months for 감봉 or 휴가단축, 1 month for 근신 (restriction) or 견책 (reprimand). It applies automatically, not at the commander's discretion.
  • The periods add up. On an 18-month term, two punishments of 휴가단축 or heavier restrict promotion for at least 4 months, so the discharge date arrives before promotion to 병장 and the record shows discharge as 상병. An earlier record also makes a later minor lapse easier to punish more heavily as repeated misconduct.
  • 강등 is a heavy sanction (중징계) and 감봉 a light one (경징계). Just before discharge, the difference decides the discharge rank: 강등 means discharge one rank lower, while 감봉 leaves the rank unchanged.
  • In one case, a service member reduced in rank shortly before discharge appealed after discharge, within 30 days of receiving the notice. The sanction was reduced to a one-month pay reduction and the original rank was restored. Outcomes depend on the facts of each case.

Discipline standards for specific types of misconduct

The Ministry of National Defense directive (「국방부 군인·군무원 징계업무처리 훈령」) sets separate procedures and sanction ranges for some types of misconduct, and the disciplinary authority (징계권자) must refer such a case to a committee unless there is a justifiable reason not to.

  • Sex-related cases (Article 9): sanctions run from 파면 (dismissal) to 견책 depending on the act. Unless the person under review is an enlisted member (병), a military legal officer (군법무관) must be appointed as the committee's secretary or case officer, and a unit without one must transfer the case to the next higher unit. In sexual violence and sexual harassment cases, at least one third of the committee must be of the same sex as the victim. Mitigating factors include an act that stopped at an attempt, the victim's statement that punishment is not sought, voluntary surrender, a passive role, and a one-off act that was not severe.
  • Drunk driving (Article 8, Appendix 2): a first offence under 0.08% falls in the 정직 (suspension) to 감봉 range, and at 0.08% or above, or on refusing the test, in the 강등 to 정직 range. Repeat offences count only criminal cases finalized with a fine or heavier in the 10 years before the latest offence, and offences before commissioning or enlistment are excluded.
  • Integrity violations such as accepting money or hospitality (Article 7): the range turns on whether the benefit is under or over KRW 1 million, whether it was received passively or actively sought, and whether an unlawful or improper official act followed. A military legal officer must be appointed as secretary or case officer in these cases too, and a unit without one must transfer the case to a higher unit.
  • A breach of these procedural rules can be a ground for cancelling the punishment and is a central point of dispute on appeal.
  • Under Article 53, a disciplinary authority that finds the committee's resolution too light may request a review or re-review by the next higher unit's committee within 15 days of receiving the resolution, and that committee may not decide more lightly. This is the authority's own procedure, separate from the service member's appeal, which does not make a punishment heavier.

When discipline runs alongside a criminal investigation

  • Article 6 of the same directive ties the disciplinary authority's handling to the result notified by the investigating agency. 혐의없음 (no suspicion) and 죄가안됨 (no offence) are closed internally in principle, with a referral possible in exceptional cases. 불송치 (non-referral) is handled according to its reason. 공소권없음 (no right to prosecute), 기소중지 (indictment suspended) and 참고인중지 (suspended pending a witness) are referred to a committee when the alleged facts are recognized. 기소유예 (prosecution deferred) and indictment are referred in principle, and proceedings may be suspended under Article 23 while a trial is pending.
  • A non-referral or deferred prosecution does not remove the risk of discipline. Units often apply internal duties separately, such as 품위유지의무 (duty to maintain dignity) or 성실의무 (duty of good faith), so the specific reasons in the investigation result notice should be built into the written opinion for the committee.
  • A punishment becomes final on its own track even while the criminal case is still contested. The appeal must still be filed within 30 days, arguing the progress of the investigation and Articles 6 and 23 to lower the sanction or keep it in dispute until the criminal result is known.

Who typically needs this

Active-duty service members and military civilian employees (군무원) facing a disciplinary punishment, a 군기교육대 assignment, or an adverse personnel decision such as a missed promotion or reduced leave allowance — as well as those who believe they were punished twice for the same misconduct, or who need to stop a sentence from taking effect while their appeal is pending.

Common mistakes

  • Not filing because of a mistaken belief that an appeal risks a harsher punishment — under current law this cannot happen
  • Missing the 30-day filing deadline for a disciplinary appeal, or miscalculating it by including the day the decision was received (it's excluded)
  • Writing an appeal without first reviewing the actual disciplinary record — an appeal built on the decision notice alone, without knowing what evidence the committee relied on, is weaker
  • Submitting a 군기교육대 legality-review opinion statement after the sentence has already been finalized, when it can only reduce a pending sentence
  • Not requesting a stay of execution when a 군기교육대 sentence is about to take effect before the appeal is decided

Timeline

The appeal or personnel grievance itself must be filed within 30 days of the day the disciplinary notice was actually received; a 군기교육대 legality-review opinion statement needs to be submitted before the sentence is finalized — often within days. A stay-of-execution request needs to be filed promptly once the sentence is set to take effect.

Frequently Asked Questions

Will filing an appeal or personnel grievance result in a harsher punishment?

No — under current Korean military law, an appeal (항고) or personnel grievance (인사소청) can never increase the original punishment. This is one of the most common misconceptions we address.

What's the deadline to file a disciplinary appeal?

30 days from the day the service member actually received the disciplinary notice, not the issue date printed on it. The day of receipt is not counted, so the calculation needs to be done carefully.

Can a 군기교육대 sentence be shortened after it's finalized?

A legality-review opinion statement can only reduce a pending sentence — it must be filed before the sentence is finalized, not after.

What if I was punished twice for the same misconduct?

That's a double-punishment (이중징계) issue, and it should be challenged through an appeal — the same act generally cannot be sanctioned more than once, whether that's a re-punishment of an already-closed matter or one incident split into multiple penalties.

Can I stop a 군기교육대 sentence from starting while I appeal?

Yes — a stay of execution (집행정지) filed alongside the appeal can freeze the sentence, and the discharge-date delay it causes, while the appeal is under review.

Why do I need to see the disciplinary record before writing my appeal?

The decision notice itself usually states only the outcome, not the evidence or reasoning behind it. Requesting the record under 「국방부 군인·군무원 징계업무처리 훈령」 제29조 shows what the committee actually relied on, which is what a persuasive appeal needs to rebut.

Can I still appeal after I've already been discharged?

Yes — a disciplinary appeal can be filed within 30 days even post-discharge, and a successful appeal can retroactively correct the discharge record itself.

What's the difference between disciplinary appeal and 전역심사 (forced-retirement review)?

전역심사 isn't a punishment for misconduct — it's a separate fitness-for-continued-service review under Military Personnel Management Act Article 37, triggered by a medical/psychological rating or a 현역복무부적합 finding, and it has its own defense strategy distinct from a disciplinary appeal.

If I'm rated at a fitness grade that normally means retirement, is that automatic?

No — Korean courts have held that the fitness-grade criteria are an internal guideline, not a binding rule, and require a holistic review of whether the service member can actually perform their duties, not just the numeric grade.

Can my parent's own letter actually help my case?

Yes, but it's most effective combined with a legal framing — proportionality of the punishment and procedural fairness of the investigation — rather than submitted as a standalone character statement.

The committee has already decided on 군기교육. Is it too late to change it?

No. A 군기교육 decision becomes final only after the higher unit's legal office completes its legality review, which checks again whether the procedure was lawful and whether the sanction is appropriate. An opinion statement filed before that review can lead to a reduction or a change of sanction. The reviewer is a legal officer, so the statement should address how the sanction standards were applied, not rely on an emotional plea. In one case, a statement prepared over the weekend before the review led to a reduced and changed sanction, and the discharge date was kept.

If my appeal is rejected, can I appeal again?

No. Once the appeal review committee (항고심사위원회) has decided, or you withdraw the appeal, the same disciplinary case cannot be appealed again. Every argument and supporting document should go into the first filing.

I was reduced in rank (강등) just before discharge. Can my rank be restored?

It can be, if you appeal within 30 days of receiving the disciplinary notice, even after discharge. An appeal that was already under way when you were discharged also continues. If 강등 is reduced on appeal to a light sanction such as 감봉 (pay reduction), the original rank is restored. In one case, 강등 was reduced to a one-month pay reduction and the rank was restored. Results depend on the facts of each case.

Is it true that two leave-reduction (휴가단축) punishments mean discharge as 상병?

On an 18-month term, yes. Each punishment of 휴가단축 or heavier restricts promotion for at least 2 months, so two of them restrict it for 4 months or more and the discharge date arrives before promotion to 병장. That is why even a light punishment is worth contesting, with a written opinion before the decision or an appeal within 30 days after it.

The police or prosecutors closed my case without charges. Can my unit still discipline me?

It can. Under the Ministry of National Defense directive, a finding of no suspicion is closed internally in principle, but a disciplinary referral remains possible in exceptional cases, and units often apply internal duties such as 품위유지의무 (duty to maintain dignity) separately from the criminal result. If a punishment is imposed while the criminal case is still open, it takes effect on its own, so the appeal must still be filed within 30 days.

Can a disciplinary result ever become heavier?

Not because of your own appeal. Separately, if the disciplinary authority (징계권자) finds the committee's resolution too light against the standards, it may ask the next higher unit's disciplinary committee for a review or re-review within 15 days of receiving the resolution, and that committee cannot decide more lightly than the first one. This is the disciplinary authority's procedure and has nothing to do with appealing. It is one reason the defense at the first committee matters.
